Trespass Affidavit Program

Community Partnership

The Wilton Manors Police Department is committed to fostering a partnership with the businesses and residential dwellings in ourTrespass sign small community as a means of ensuring public safety. We believe that the Trespass Program will assist our ability to better address quality of life issues within the community, as well as through the judicial system when resulting arrests are made. It is by working together to make our community safer that we achieve our common goals. When an owner has identified a trespassing problem at his or her business or property, the owner or legal representative may request this service.

NOTE:
This is a voluntary program. Multi-family properties, businesses and HOAs may participate, but only common areas are covered; the individual residential units are not (i.e., individuals actively invited to visit a tenant).

Trespass Law:

Section 810.09, Florida Statute provides that trespassing on property other than structures or conveyances occurs when an individual(s) has entered land which is properly posted and the individual is warned to leave the property and fails to do so.

Police Authorization:

Enrollment into the Trespass Program authorizes the Wilton Manors Police Department and its officers to act as agents of owner/property management in enforcing the provisions of Florida State Substantive Law (FSS) 810.08 and 810.09.   Officers of the Wilton Manors Police Department are specifically authorized to make reasonable requests to leave of any persons in or on the premises at a time or in a place wherein the premises are not open to the public. Furthermore, the officers are authorized to act as agents of the owner/property management in the barring, or subsequent arrest and prosecution of any persons who refuse a reasonable request to leave given by officers.  By following these steps, any Wilton Manors police officer can act as your authorized representative, even in your absence, to order trespassers to leave your property.
